How This Works

FOIA 2000: public authorities must respond within 20 working days. Working days = Monday–Friday excluding bank holidays. EIR 2004: same 20 working days, extendable to 40 for complex environmental information. UK GDPR SAR: 30 calendar days, extendable to 3 months for complex requests. If the deadline falls on a weekend or bank holiday, the deadline is the next working day.

If a public authority fails to respond within 20 working days: (1) Follow up with a written reminder. (2) Complain to the Information Commissioner's Office (ICO) at ico.org.uk/make-a-complaint. The ICO can issue enforcement notices requiring compliance. This is free. For Subject Access Requests: complain to the ICO if the organisation fails to respond within 30 days. Most complaints are resolved without formal enforcement.
